The lawsuit at issue was filed in the Circuit Court of the 16th Judicial Circuit in and for Monroe County, Florida. The case was assigned a case number of 12 CA 502P and the defendant named in the case was Locust Center, LTD., Inc. The case was filed under a legal theory of premises liability and the plaintiff sought damages as compensation for the losses incurred as a result of the alleged incident.

Specifically, the court documents relating to this case alleged that the plaintiff was legally on the premises of the defendant that was located in Monroe County Florida. While she was there, she slipped and fell on a set of stairs that were wet. The court documents alleged that the defendant either knew or should have known of this dangerous condition and that the defendant failed to either take proper steps to remove this dangerous condition or to properly warn foreseeable users of those stairs that they were wet, slippery and dangerous.

The court documents went on to allege that as a result of slipping and falling on these negligently maintained stairs that were located on the premises of the defendant, the plaintiff suffered back injuries that required medical care and treatment. As a result, the plaintiff incurred damages that included medical costs and pain and suffering.

Rather than litigate the case in front of a judge and jury, the defendant decided to work out a settlement with the plaintiff that was negotiated by the Key Largo personal injury lawyers at Bernstein & Maryanoff. This settlement concerned a payment of damages to the plaintiff, and the amount is not being disclosed per the confidentiality terms located within that document.
